In exercise of the powers conferred by sub-section (1) of Section 5 of the Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of 2004), the Government of Karnataka hereby exempts for a period of three years from the first day of June, 2009 to thirty–first day of May, 2012, the tax or amount payable by way of composition by a dealer under the said Act on the taxable turnover in respect of transfer of property in goods in the execution of civil works contract or on total consideration for the civil works contract executed by him, for expansion project of Toyota Kirloskar Motors Limited, Bidadi Industrial Areas, Bidadi, Ramanagaram District. Subject to the terms and conditions specified in Government Order No. CI 432 SPI 2005, dated 12th June, 2009 and further subject to the following conditions and procedure, namely.-

The tax or amount payable by way of composition under the said Act on the civil works contract executed for expansion project of Toyota Kirloskar Motors Limited shall be remitted to the Government Treasury in the prescribed manner. |
(2) |
Toyota Kirloskar Motors Limited shall claim refund of the tax or amount by way of composition paid on the civil works contract executed for its expansion project in the prescribed return submitted to the jurisdictional Local Vat Officer. |
(3) |
The refund claimed under this notification shall be made by the jurisdictional local VAT office within thirty-five days after the end of the month to which the return relates if it is furnished within the time specified under Section 35 of the said Act, or within fifteen days from the date of filing the return if it is filed after the time specified, in the manner prescribed under Rule 128 and interest shall be paid for any delay in the refund as specified under Section 50. |
